The Historical Evolution of Drug Laws and Criminal Responsibility of Children in Iran

Abstract

The issue of juvenile delinquency is very important because, on the one hand, society should be protected from juvenile delinquency crimes, and on the other hand, effective measures should be taken to correct and re-educate juvenile delinquents so that they are no longer drawn into criminal ways. In a sense, criminal law today is based on the premise of responsibility. In this regard, children are considered unpunished due to lack of intelligence and discriminatory power and are not responsible, while in the past children were punished like adults, but although children are not criminally responsible and exempt, taking some security measures even sometimes it is necessary to carry out some lenient punishments on them. This research is intended to study the written laws in the field of the historical evolution of drug laws and juvenile criminal responsibility in Iran descriptively and analytically. Studies have shown that if children and juveniles commit one of the crimes subject to the jurisdiction of the First Criminal Court or the Revolution, their crimes will be tried in a special criminal court for juvenile delinquents and the accused will receive all the privileges which are applied in the juvenile and adolescents' court.
